ARTICLES OF CONFEDERATION OF THE UNITED STATES OF AMERICA

The Articles of Confederation were proposed to the states on November 15, 1777 but were not declared in force until March 1, 1781.  At that time the Continental Congress officially became the United States in Congress Assembled.  Articles IX, X and XIII of the Articles of Confederation also refer to the congress as the United States Congress.  The use of the term Confederation Congress is an expedient not supported by language in the original document.

REPORT OF GOVERNMENT FOR WESTERN LANDS

On March 1, 1784 Thomas Jefferson issues a committee report entitled a Report of Government for Western Lands.  The western lands, also known as the northwest territory, is comprised of an area generally south of the Great Lakes, east of the Mississippi River and north (northwest) of the Ohio River.

The report first proposes resolving long-simmering rivalries between the 13 original states by creating new states in this area to the west of the original 13 rather than ratifying an expanded territorial reach of any of the original 13 states. The report also calls for the prohibition of slavery in the region.

Although the region is not well mapped nor extensively explored the report suggests dividing the area into ten states of roughly equal size, to be called: Sylvania, Michigania, Cheronesus, Assenisippis, Metropotamia, Illinoia, Saratoga, Washington, Polypotamia, and Pelipsia.  Many of the names suggested are a peculiar mixture of Latin and of various Indian languages.

The State of Sylvania was proposed to include much of present-day Minnesota, Michigan’s Upper Peninsula and some of northern Wisconsin.

The State of Michigania was proposed to include most of Wisconsin, but nothing of Michigan.

The State of
Chersonesus (the Greek word for peninsula) was proposed to include most of Michigan’s Lower Peninsula.

The State of Assenispia (named after the Assenisipi River, also known as the Rock River.) was proposed to include
the northern part of modern-day Indiana.

The State of Metropotamia was proposed to include southern Michigan and parts of northern Ohio and Illinois.

The State of Illinoia was proposed to include most of Illinois.

The State of Saratoga  was proposed to include most of Indiana.

The State of Washington was proposed to include most of Ohio.

The State of Polypotamia was proposed to include most of western Kentucky.

The State of Pelisipia was proposed to include most of eastern Kentucky.

Technically Polypotamia and Pelisipia are beyond the limits of the western lands because all of Kentucky is south of the Ohio River.

THE ORDINANCE OF 1785

Passed by the Congress of the Confederation on May 20, 1785, this is considered one of the most important legislative acts in American history. The Ordinance of 1785 established a method for the survey and sale of Western lands by the federal government.

In 1780, the original 13 states began to cede their claims to land between the Appalachian Mountains and the Mississippi River. At the same time, a debate developed over how to dispose of those lands once they were acquired by the federal government. Some people believed that the lands should be surveyed into uniform units before sale, while others thought that individual speculators should be able to make their claims as they saw fit. The Ordinance of 1785 was a compromise solution.

The ordinance decreed that the federal government would survey the lands into individual townships, each of which was to be six miles square. These townships would then be subdivided into 36 lots of 640 acres (one square mile) each. These lots could then be further subdivided into rectangular units. Once this had been completed, the townships were to be sold at public auction for not less than $1 an acre. The ordinance also contained a provision setting aside one lot in each township to provide funds to maintain public schools.

“As the United States acquired further territory — as in the case of the Louisiana Purchase in 1803 — the ordinance was applied to these new lands, until eventually its jurisdiction stretched to the Pacific Ocean.” – Interesting, considering this ordinance applied only to lands purchased from the Indians and that were ceded by the original 13 states.

CONSTITUTIONAL CONVENTION

The United States Constitutional Convention (also known as the Philadelphia Convention, the Federal Convention,or the Grand Convention at Philadelphia) takes place from May 25 to September 17, 1787, in Philadelphia, Pennsylvania as the Congress of the Confederation meets.

The purpose of the convention is to address problems in governing the United States of America, which has been  operating under the Articles of Confederation since winning  independence from Great Britain.  The Convention is purportedly intended only to revise the Articles of Confederation, but many of the conventions supporters, among them James Madison and Alexander Hamilton, want to create a new government system rather than fixing the existing one.

The delegates elect George Washington to preside over the convention.  One result of the Convention is the adoption of the United States Constitution.

NORTHWEST ORDINANCE OF 1787 IS PASSED

Pressure to settle the western lands accelerated after the 1784 Thomas Jefferson committee report was issued.  The Ohio Company (Ohio Land Company) and other speculative interests were interested in legitimacy from the United States, in Congress Assembled when it met in late May of 1787.  Discussion began regarding not only the clarification of the land area in question, but also, the issue of how to admit the proposed states.

On July 13, 1787 the Northwest Ordinance was passed.

The Northwest Ordinance, established the basic framework of the American territorial system. Ir provided that after a period of direct rule by congressional appointees, the Northwest Territory and its subsequent subdivisions would enjoy a limited measure of self‐government until, when their populations reached sixty thousand, they were entitled to draft state constitutions and claim admission to the Union on equal terms.

Adoption of the Northwest Ordinance also reflected Congress’s determination to implement the land policy outlined in the land ordinance of 20 May 1785.  This policy guaranteed secure titles and made provision for law and order on the frontier.

The Northwest Ordinance provided for the creation of not less than three (3) nor more than five (5) states.  Statehood in the Northwest Territory was gained consecutively by Ohio (1803), Indiana (1816), Illinois (1818), Michigan (1837), Wisconsin (1848).

ADOPTION OF THE UNITED STATES CONSTITUTION

September 17, 1787

Article. IV.

Section. 3.

New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.

The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States; and nothing in this Constitution shall be so construed as to Prejudice any Claims of the United States, or of any particular State.

Section. 4.

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.

NEVADA STATEHOOD – 36th STATE OF THE UNITED STATES OF AMERICA

On October 31, 1864, Nevada becomes the 36th state to be admitted into the Union as President Lincoln approves the Nevada Constitution.  The capital city of Nevada is Carson City where the Nevada State Capitol is located.

On March 21, 1864 President Abraham Lincoln signs the Enabling Act for Nevada that was passed by the Thirty-eighth (38th) United States Congress.  The enabling act stated that Nevada would achieve statehood when and if it wrote an acceptable constitution, which would include certain stipulated provisions. The constitution would be reviewed by the President, and, if approved, Nevada would be admitted.
